Jordan99940 Posted February 9, 2012 Share Posted February 9, 2012 Hey guys on Monday night I was in an unfortunate accident I was a passenger in my friends (recently purchased) Maxda MX-5 as he was coming off a roundabout it was a bit wet he lost control swerved across the road before eventually going sideways (passenger side on) into a BMW and head on into a 10 plate Fiesta, my friend has no gripes saying it was 100% his fault and I'm not looking for the blame game to commence, but in the crash he has clearly written of his Mazda and the BMW driver cracked a rib and the Fiesta, well new cars are very rarely put right these days so wouldn't be surprised if it was a write off to, In the accident I was not wearing a seatbelt how ever would have made now difference to the events of the major talking point of me hitting my head sideways on the roof of his car and; http://www.evo-host.co.uk/getimg/28702.jpghttp://www.evo-host.co.uk/getimg/28703.jpg yeah lovely little imprint of the roof frame on my skull, I also suffered broken glass to the face and a bit of bruising and cuts and general soreness along with the compulsory whiplash. my question is I Don't want to claim against my friend if it will increase his premiums for next year, obviously the BMW and Fiesta driver and owner are going to claim against him but if in a claim stating I received whiplash in the accident would I be harming it even more? or would me not wearing a seatbelt void any claim I go to make? shawdreamer Posted February 9, 2012 Share Posted February 9, 2012 you wernt wearing a seatbelt....... meaning you showed considerable disregard for your own and others safety....... therefore you have no right to winge when you get hurt. morally Id say you should learn to belt up, both verbally and safety wise and put this incident down to a strong learning experience. ganges Posted February 9, 2012 Share Posted February 9, 2012 1st, glad you are ok!!!!, i am pretty sure (not a legal boffin), that if you admit, or it is proved you were not wearing a seatbelt, you will not have a leg to stand on, i have to state the obvious, why were you not wearing a seat belt, your mate's primiums are going to be hit anyway, because of the other drivers. Jordan99940 Posted February 9, 2012 Author Share Posted February 9, 2012 Forgot I asked in the question if I should have been wearing a seatbelt thanks for clearing that part up for me guys, My bad, I forgot everyone is perfect and does everything correctly first time and that if you make a mistake in your life you post it up on here and are willing to admit you done wrong it means that you want all this criticism fired straight back at you. people that love to miss the obvious question and make a B line for the 'seatbelt bandwagon'. What is it with fuds on here recently asking a question, not getting the response they want, then having a moan at reasonable folk? Any normal person would appreciate that they're lucky to be alive after their spastic mate writes off 3 cars while driving like a c-unit. Not try and make a quick buck from relatively minor injuries. You're probably too short sighted to realise, but it's not just his premium that would be affected. It's shizz like this that pushes all premiums up. On a side note. I've never known a new driver (like, someone who learned within the last 20 years) not to authomatically put their seatbelt on when they get in a car. I Didn't realise you was there and saw him driving like a 'c-unit' either that or I must have stated it without realising in my OP because he was driving A little too fast. Wouldn't have been an Issue but a combination of a wet road and rubbish tyres and inexperienced driving leads to an accident that yes could have been prevented but accidents happen do they not? Well I guess if you have done it before you can make comment about and judge everyone else by your own mistakes. Hit a dip in the road as I was approaching a corner a little too fast. So driving 'too fast'.....On a roundabout.....In the wet....With rubbish tyres....And writing off 3 cars..... Is not driving like a cnut?
