You can pull away in 5th gear with no acclerator on a flat road in my nova 1.4 sr. Will go on without stalling aslong as the road is flat.

Surely they could tell that you hit the car from the side at the rear............. as opposed to just hitting him up the ass......... Keep pursuing it, dont back down on this one. Take it to court, he will probably crack under pressure. At the end of the day, you have done nothign wrong, so you wont have to worry about keeping your story straight. If the witness was in your car, I think it can be put aside, as they are not independant. But yeah, a lesson for you and everyone really, I only learnt this from work (truck driver) but pick up a disposable camera and take pictures of the accident scene etc. if you should be unlucky enough to have an accident.

I think you will find traffic offences like this are 14 days.

OK how did the old man pull out? Did he pull out in front of you, or pull out into the side of your car? Has your car been repaired? If so, did you take pictures of the damage etc. Sorry for all the questions but you can proove he was at fault by where the damage on your car is, and the damage on his car. I had some woman stripe the side of my car when she attempted to change lanes with me already alognside her....... the insurance company said they can proove she pulled out into me, by looking at the damage etc. Always worth carrying a disposable camera with you at all times. Just stick it in your glovebox. Unfortunatly with accidents you never get the details side of thing right first time, its a skill you aquire over time I have a long list of things to do and check if I have an accident at work, mainly to cover my ass. Just say its been lowered. You bought the kit second hand or something. IMO if you declare stuff to the best of your knowlege you are OK. I mean lowered is lowered wether its -40mm or -120mm.

Ive already admitted to going over the top with my 100 in a 30 comment. 40 isnt an excessive speed IMO, lets face it, everyone has done it without realising. I know thats gonna come across as hypocritical, you could argue that doing 40 by accident is the same as runnign out in front of a car by accident, but its two different thigns entirely.
