Matt86 Posted November 23, 2008 Author Share Posted November 23, 2008 Yeah you are right Meeksta, if it was any vehicle moving at a normal speed then there would have been plenty of time to get out of the way... therefore its not totally my fault... but still is my fault as it was me losing control...I have made a complaint about the amount of parked cars though, always causing massive problems and they have been doing surveys all week about it before this even happened. Stupid thing is, the parked car I went into... the woman was in a shop doing her shopping... the shop has a bloody car park but she choses the edge of a road! Matt86 Posted November 23, 2008 Author Share Posted November 23, 2008 I was moving from my lane into the middle at the time so wasnt directly in the middle hence ending up into the back of her car, police were moving into the middle at the same time. I think the problem is that with you hitting the parked car rather than the police car that person obviously needs to be paid by someone & as it was you & not the police it leaves only one option for them. Barry-334 Posted November 25, 2008 Share Posted November 25, 2008 shame to hear about that Matt, at least you already had a new one lined up! if the police had their blues on, they usually use that as their excuse for not driving "normally" and if you hit a parked car, then only you can be at fault (sorry!) and that person needs to be compensated for their loss. probably the best outcome, would be if your insurance pay for the Yaris, and settle your claim Cash-in-lieu, so you get to keep your car to repair & sell, or break so you can fund the cab. Ive been in a similar position and was told by the police, my insurance company and the transport company which caused the crash that the 'best' (why do they use that word) thing to do is to hit the other person head on. Only then can you prove it was their fault in this situation. Avoiding the other car and hitting something else magically appears to be your fault. Ironically, smashing the police car up would have been the favourable decision although thats not quite whats going through your head at the time is it! I have a 400pound excess so I need them to write my car off and pay me out for it to cover the excess. I currently have less avaliable cash than the excess so If I have to pay the excess then both cars will be leaving my hands.
