You could do both, but you could also end up being sue'd. I'm doing about civil law now in college and contract law. Theres lots of nasty things you could do but theres also a hell of alot of counter things they can use against you if you do both!

I know, i wasnt planning on doing both at all ...

 

Basically whats been said at the moment is:

 

He is on his mums insurance as a named driver,

His excess is £500!

His mum said at the scene i dont want to go through insurance, id rather pay for repair.

My car got quoted over £1,500 for repairs.

 

I suggested they buy me a new car as once he has payed his excess he might aswell for the extra couple of quid and the lack of hasle. Plus if he goes through the insurance i am abliged to inform the police and he could be done for driving without due care. Nice fine and as ive read could be upto 9 points. Liscence gone for him. If i was him and his mother id buy me a new car and take it as a lesson!

IF u dont tell ur insurance company very soon they may not sort the claim out, so if theyre stringing u along while they get their car sorted then by the time u've realised they aint gonna pay u all evidence of the crash is gone apart from ur word.do u have pics and witnesses?

 

Tell them you want the money this week or ur gonna phone the insurance and old bill (they can open an overdraft or get money from theyre credit cards or whatever if they dont have the cash)

Its sorted Craig, Went through the insurance the day after the crash, already got a courtesy car (brand new Astra 1.6) and he and his insurance have admitted full liability.

 

As for my car its being taken away Monday to a compound where it will be assessed and then more than likely wrote off.

 

So at the moment I'm in the process of taking everything that i want off the car and replacing it with the standard gear.

 

I also claiming personal injury for the accident and have been to the doctor, who said i came off quite lightly and i was lucky. Soft tissue damage has been diagnosed so far.

you can tell your insurance company you want the car to stay in your posession...

then they will offer it you back for 100 quid and you can break it and sell all the bits you dont want.

Then you can get a scrappy to take whats left off you for 30 to 70 quid ;)

Pewrsonally I would mantain posession of it and ask for first refusal or tell them I wanted to keep the salvage :)
