I took out a franchise on 28th may, through a company that I used to work for, in with the franchise they gave me all the tools and equipment and point of sale I needed for the franchise and also gave me a van in with the franchise. 3 weeks into the franchise, the van they gave me broke down, they BOUGHT THE VAN BACK OFF ME for £500 and said they get mechanical work done fairly cheap so they got no problems giving me £500 for THE VAN. 6 months down the line I handed in my 6 months notice to cancle the franchise agreement as the money I was earning (£2k-£3k per week) was never filtering through, so they got a bit shity with me and was fairly dissapointed, but after a few nasty phone calls they said they come round and see me today to get there eguipment back and they will buy my van off me. Checked all the equipment back in, checked van over, test drove van, asked for the log book to fill in, and then . . . after I gave them the log book, they gave me an invoice for £1,300 for stuff they gave me at the start of the franchise that wont be able to be re-used . . . and then said they will not be buying the van off me cos I owe them £1,300 and they will just be taking the van, went to drive off so I stood in the way so they couldnt drive away, phoned the police, told the police what was happening and then he listened to there side of the story which was . . . they gave me £500 towards this van so they are the OWNER" of the van, so the police said I gota prove that im the owner of the van otherwise they can take it, despite the log book being in my name. would appreciate some legall advice if any one can give me any Kind regards. Was this for you to buy another van? yes that is right, when I took on the franchise they gave me a van, it broke down with in the first month so they said they would BUY the van back off me and get it fixed (which they did do) I then went out and bought myself a new van (well my mum and dad did) but today when they turned up they said that they "own" the van as they paid for it, even though the van was more then £500, and today was the first time they had even seen the van and basically, even though I am the registered keeper of the van, and have a receipt as proof of purchase and paying in cash, the police said they can not stop these guys from driving off in my van Link to comment Share on other sites More sharing options...

I can not go over and drive the van back, van only had one key and they got the key lol Thing that annoyed me was, the police said I had to prove the van was mine, but they also had nothing on them to say the van was there's but they where the ones aloud to take the van not me, also the van is registered in my name so they could go through red lights, speed cameras and all the tickets will be coming to me surely the police officer should of said that if they could not prove the van was theres then it stays with the registered keeper, absolutely shocking Link to comment Share on other sites More sharing options...

Spoke to my cousin who is training to be a lawyer and she said they had no right taking the van regardless of the debt that they say I owe them, with out having written consent by a solicitor, and also that when they drove off that was theft of a motor vehicle so needs to be reported stolen, but I tried to report it stolen and the police would not let me and tbh peewee I let them test drive the van so they already had the key, I probably should not of handed over the log book until they gave me the money. will not be so trust worthy with people any more tbh.
