Wrong engine CC on V5

I'm actually baffled your dragging this thread on, its incredibly ignorant to assume people are basing their posts on a gut feeling. The law is there in black and white, an engine change is either declared or undeclared.

 

Your getting far to hung up on engine capacity. For example a 1.6 Zetec vs. a 1.6 turbocharged CVH, both 1.6's but very different engines with regards to power output, emissions etc...

 

I think what Eldarto posted off the DVLA site is evidence enough, its misrepresentation, fraud and in the event of an accident where an investigation is required, it will most probably lead to a more serious crime. Why do you think in most european countries, vehicle modifications must pass significant safety tests (TUV etc,) must be declared and in some instances like Switzerland, banned altogether. Sadly the UK is far too lax about this sort of thing and its partly why our insurance prices are so high.

I'm just gonna be completely blunt here. I think this thread is utterly stupid and pointless. If you really want to find out, call the DVLA, VOSA or ask the police yourself. If you dont wanna ask them in person, there is a website where you can ask questions anonymously.

 

Im my PERSONAL OPPINION, if he's insured the car as a 1.6 or whatever it is, and its got a bigger engine, his insurance will be void in the event of an accident where he's at fault. And he can't claim ignorance either, because you've posted this thread, and he's obviously told you. Nice one there. But, as you said, you're not bothered about oppinion, no matter on how unanimous it is.

 

Here's something else to think about though, IF he does have an accident, and his insurance IS invalid as a result of having a larger engine fitted. Your friend will more than likely receive one, or a combination of the following: Go to prison, Lose his license, receive a ban from driving, be unable to insure cars in future, receive a fine. And I gotta say, if you let your friend continue using that car, knowing this, then I'm FCUKING GLAD you're not my friend.

Your friend needs to either

 

a)change the engine CC on the V5 (failing to do so is breaking the law) and tell the insurance company what engine he has in his car and accept the increase in premium such a swap brings

b)sell the car cos he cant afford to insure it legally (which must be the only reason he isnt being honest about it all)

 

His insurance is currently VOID!!! He may be passing ANPR checks when the police drive past him but if he were to have a crash or have a keen copper look under the bonnet the chances of them finding out what is going on are slim but they are there. And he will be severely dealt with when they do catch him. If he crashes into someone and his insurers spot an RS2000 engine in a 1.6LX he will be paying for the damage out of his own pocket,and also paying a huge fine,getting points/bannes/jail time!! (THIS IS FACT!!) ALL DEPENDS ON THE JUDGE but he will not get off with a warning.

 

 

Tell him to go the whole hog and just drive it untaxed,uninsured,unMOTed and suck the fat one!!

 

Just out of intrest what car are we talking about here and what engine has it gone from/to?

Wow! Some people seem to feel pretty strongly about a simple question!

 

I really don't see why my asking here for some expert advice or first-hand experience is 'stupid and pointless' (isn't this an insurance questions area?) or that I am 'incredibly ignorant' for questioning where people have got the information they have posted (not everything people post on forums is true you know). If they are facts, then simply tell me where they came from is all I ask! If people want to post thier opinions thats fine and dandy with me and I most probably agree with them...but as I've said a few times, I'm trying to find the facts!

 

I saw Eldarto's post and it was interesting, and good of him to make the effort to provide links, but didn't really answer the question - it just stated that you are supposed to tell the DVLA about changes. It didn't say anything about what would happen if you don't, or what the insurance implications are.

 

But anyway, thanks for your replies :thumb:

the issue is that the 1.6> 1.8 engines look identical its only the internals that differ,, so it would have to be a full investigation to un earth that

 

You mean apart from the large "1.8" cast into the front of the block?

phone the fcuking police urself and ask them as they are a relaible source. I know it is a fact that they will fcuk u over for not delcaring to the DVLA and insurance but im not ringing and having a conversation with them just so i can post "a policeman told me this and referred to such and such a law"

 

 

Next you'll be asking which part of the law PROVES that driving at 80 in a 70 is illegal and what can the cops do..

It's strange that they use such mild terms as 'could' - you'd have thought that if the situation were in fact as clear cut as some suggest that they would use stronger terms. "Your insurance will be invalidated and you will face criminal prosecution" would be more appropriate maybe?

 

Craig: Look, I've tried to be polite but since you see fit to start swearing at me (for no good reason) I''l be blunt: I have asked for expert or first-hand advice and it seems pretty obvious to me that you aren't an expert and have no such experience - so why are you even posting here? I was expecting to have few replies to this post, since I imagined it to be a fairly rare occurence. Perhaps one brave soul might admit to it, or the local insurance expert might pop in and comment.

So that you can show everyone how disgusted you are that this sort of thing might happen? Oh right, becuase I'm sure you've never broken a law in your life (how about that speeding one eh? He's been on this forum alot longer than you or I have, and I'm sure he doesnt want to see a stupid thread dragged out by some fool who cant take no for an answer. Why do you think? Cnuts that drive without valid insurance are the reason why we pay so much money for insurance in this country. Its not clever and the if you can't afford to insure something faster, then its highly likely you aren't ready to be driving something faster...

+1 for Endsleigh! :roll: I got my renewal through yesturday and that wanted to add an extra £40 a month. I was like wtf, phoned Admiral and a few others, and the quotes are less then half what I pay now. I'll never go with Endsleigh again, almost a year and they're still sitting on the paperwork of an accident.

OK, so the guy has been on here longer than either of us - so what? Does that mean his word must be accepted without question? Does that make him an insurance and legal expert? No, didn't think so.

I can't make it any clearer than I already have - I didn't expect a large response although this particular area is frequented by a rep from Chris Knott is it not? Then surely it is a reasonable place to ask such a question without getting directly involved, which by contacting an official agency directly I risk doing.

 

I have made no research into Craig's history, I was merely picking up on his facetious comment about the rules regarding speed limits. If this has some particularly painful associations for him, then I apologise.

 

Anyway, rest assured that you have done a great job of ruining a perfectly reasonable thread. I hope you are very pleased with yourselves!

In that case, why didn't you drop him a PM instead of making a thead which was bound to cause a bit of friction? Its apparent enough even from the responses on here that what your talking about is fraudlent/ illegal, accept it and move along...

I not quite sure why some members are getting so worked up tbh & throwing a few nasty replies about.

He stated that this question was to inform a friend with viable info so as too stop him from driving illegal.

Saying " if you let your friend continue using that car, knowing this, then I'm FCUKING GLAD you're not my friend." is a tad strong, as isn't that exactly what he is trying to do (he isn't his friends keeper & certainly cant enforce his ability to continue to drive said car). :unsure:

The post is closed but the guy has to declare the higher cc to his insurers or they may decline any claims. It seems his guy has been modified.
