BMW E36 328i Convertible

Some cunit smashed into me :(

 

So, one of my fabolous alloys need refurbishing, track rod end,probably a few other steering components, wheels point in different directions, so car is unusable,

 

scuff to wing, bumper,

 

t*at tried undertaking me when I was pulling off the road onto my drive, taxi drivers, and Asian, what are the fcuking odds.

I went ballistic, I don't know how i never managed to not smash his car up

 

To top it off, traffic on the road was beeping, coz my car that couldn't move was in the way, so they got a mouthful, they soon shut up.

 

the guy asked me money for his damage, that just topped it all off, my father pulled me into the house before I did something stupid.

 

I instantly rang my insurance, got as many details of this dude that I could, he was blaming me, what an idiot, in the end told him insurance will sort it, left it at that.

 

I'm not claiming on my insurance, if his insurance doesn't pay out im not that bothered, my NCB is more important.

 

I just hope the guy explains exactly what happens, with no lieing or twisting the truth, if he tells the truth, and admits i indicated during my whole manoeuvre then my insurance company said he is liable. but its more than likely going to end in a dispute.

 

Insurance told me they would write it off without a doubt if I claimed, I'm desperate to get this car back on the road ASAP, so just going to keep all my receipts for parts and at least if his insurance pay out i will get my money for parts back.

 

 

Oh, 30 mins after ringing my insurance, this guys insurers rings me (my insurers must of got in touch with them straight away) asking me to give my side of the story, statement, I told them I had already done so with my insurers, they then tried to pursue and ask if I wanted to add any details, wtf!

 

I just told them that my insurers know all the details, and they will deal with you,

 

Is that common? not sure what I should of done there

well 3rd parties insurance admitted to liability.

What exactly happened??

 

I guess you could always buy it back if they do end up writing it off.

 

I was on the correct side of the road, just about to pull onto my drive (left) my drive is kinda tight, and with the worry of kerbing my rims I swing out onto other side of the road, not completely on the wrong side of the road, but a good half way,

 

so as i swing to the right, mr taxi drivers a couple hundred yards away was now up my arse, indicating to pull onto my drive, the cunit decides to try and under take me, causing a hit to my front wheel,

 

if i don't swing wide to get onto my drive, the front drivers wheel will hit the far side of the kerb, and the back passenger wheel will hit closest side of the kerb, its not a drop down kerb either, its just a full on 90 degree plumit. does my head in

I sorted out my track rod end, and got the tracking done, just so I could get it on the road, i have to send my receipts away to get my money back,

 

Bodyshop came and had a look to quote up the work for insurance, im just waiting on approval of proceeding to get it done, coule take a while.

I think your lucky for them to admit liability tbf Mike.

Firstly if this guy "undertook you" as you pulled over to the right hand side of the road (fully or not) technically he was still driving on the correct side of the road (your indicator would be your word against his).

Also it could be argued that you should be reversing onto your drive seeing as it is illegal the reverse out from a drive onto a main road.

There is also the fact that contact was made to the front wing, bumper & wheel seeming that you pulled into his path as he was already half way past your car (right or wrong this should of been visible as you manoeuvred toward your drive in your wing mirror)?

Oh don't get me wrong I do think the guy is indeed a knob. A little careless & lacking in observation in mikes case.

As far as I always led to believe yes your not supposed to reverse out onto a main road from your drive (happy to be corrected with genuine knowledge on the subject)?
