Had a crash last night..

Right, was pulling out of a junction where cars where parked right on the corner, edged out, saw the car coming and stopped, but he carried on (Silly old c**t) and his rear quater hit the front of my car, now hes saying its my fault, which it partially is yeah but he didnt stop, he was going about 20mph i think, well i dunno it pushed my car back though and bent in all the arch on his while just smashing the light on mine.. yeah that bits ok, but now hes doing me for whiplash? and on about taking me to court for it and all? i mean i know im only 17 but i wasnt that much in the wrong was i?

You say "his rear quarter hit the front of you car", more like you hit his rear quarter though surely, he was driving along as you pulled out as you say, if your stopped how can his rear quarter hit you?

As for whiplash or any other claims this will be through your insurance & your unlikely to go to a court for it.

Moved to a more suitable location maybe pending pics?

Read my crash thread, exactly the same thing happened to me as I was pulling out. There were cars parked on the corner illegally I couldnt see (this was backed up as they were on double yellows), I edged out and a woman (who was speeding) went into me at about 45/40mph... The insurance went in her favour and I was left with a hefty claim... Sadly the sueing culture today seems to have taken, people claim for ridiculous things - All it does is puts everyone elses insurance prices up... I didnt go for whiplash or damages, even though my face was pretty battered from hitting the side window.

 

All I can say is get some legal advice because if its anything like my experience it will run and run...

whiplash doesnt occur unlesh your head is shot in a different direction suddenly. scrapping along someones car wouldnt cause it unless he came to a dead stop. and yeah as said unless he was going sideways its strange how you hit his rear quarter if you were stationary. good luck but i wouldnt hold out for a win.

 

people blag as much as they can when it comes to claims. best advice for after an accident is to not start arguing and just dnt get involved when they start shouting it was all your fault.

 

i hit someone from behind once, but my argument was she was on the phone and pulling onto a roundabout which was empty, she went over the give way line as it was clear i moved forward looked to my right and she'd stopped on the first lane of the round about for no reason. og course she had to say goodbye to whoever was on the phone before getting out of the car. she said it was all my fault but i said, phone is illegal, over the give way line and stop for no reason is causing a dangerous situation on the roundabout and she had a kid in the car while she was nagging. they tried claiming for whiplash but at less than 10mph which didnt work lol. still i got stuck with it as my insurance told me they werent even gonna try to fight it even with £50.000 of legal cover.

They wont fight it as theres nothing to fight, if you hit someone from behind you were expected do be at a safe stopping distance whatever the actions of the person in front (im not nagging btw as i have done it myself last year remember).

yeah i know, but when the person you hit is breaking the law in more than one way, you think there might be a chance but they dont give a Shite about that. lol thats my point. any slight chance that the finger will get pointed at you, dont hold your breath lol

 

i just thought, you say that person hit you on their rear quarter. were they turning right into the corner? if so you may have a chance if you were stationary. as it'll be the other persons fault for not leaving themselves enough room to go round the corner, providing you werent too far out in the road maybe.

Oh yes i 100% know what you mean, unfortunatly it doesnt work like that as like i said i found out 1st hand.

well you saw him and you stopped right, so he should have seen you stop and should have avoided it then it would have been shaking fists and blaring out the horns! so the other driver was driving without due care and attention as he should have been aware that there was a junction ahead of him and a car parked up illegally close to the exit of the junction. that picture you showed us should provide enough evidence to help your case. and whiplash?? to get that proven he needs to be seen by a doctor. by the looks of it he seems alright bending his neck down to write down his details, if he had whiplash he would have been struggling to move his neck for sometime and be in some agony! was he when he got out the car?

 

but you would have to be able to prove everything to favour in your case, and tell the insurance company everything he done and said to you. did you argue back to him?

 

so if he does try to claim whiplash off you, it would certainly be a false claim which would not help his case at all.

 

but as said before some insurance companies blame the person moving out, but you couldn't see Shite as the car on the corner is parked up badly and you couldn't see much coming from the left. just try and prove as much as you can to help your case and make him look like he's the one that was in the fault so therefore he would have to claim on his insurance without liability. anyways it doesn't take that long to sort out a rear quarter. just don't claim on your insurance! and replace the headlight!
