Aren't you locked in the back until the driver takes his foot off the brake or whatever it is that unlocks the doors once the vehicle isn't moving. What if you say in your statement you told him to put his seatbelt on when you noticed him moving about? Surely then its all his liability not yours? escortedal Posted January 6, 2011 Author Share Posted January 6, 2011 update on this, went to court today to attend a pre trial diet,(make sure both sides are ready to go) lawyer come to me wishes me a happy new year, then tells me that due to the report that was conducted on my behalf from a road traffic expert and ex senior police officer. the case against me has been dropped, im a free man and no conviction of any sort will be going against me,thanks to all that offered advice on here.so much stress and uncertainty for the last ten months.all gone now. I'm amazed the scrote even managed to get a Lawyer to fight his side even for a second, or is that why its been dropped? escortedal Posted January 6, 2011 Author Share Posted January 6, 2011 it was continued from september to allow my lawyer to obtain the report from the traffic expert.the charge of dangerous driving was coming from the two police witnesses that saw the incident but failed to realise that he was infact jumping from the car window.i dont know if i can claim any compo for ten months of stress, beleive me, not a position that i would like to endure ever again.( next time i think it may be a visit to a quiet spot with a few taxi mates,to discuss any matters they have of not paying ).the wee scrote is still pursuing an injury claim,but i think that may go nowhere now that it is proven his actions resulted in his injuries.no costs to me as covered by legal aid.
