I would have to say the truck was half in half out of the junction, that road is a 60mph zone, in one picture you may be able to see the tyre marks of the lorry from the junction, thay appear to be heavily to the righ of the junction which is I think 20 -27m wide, I measured it yesterday, so in essence he was on the wrong side of the junction coming out of the petrol station, there is another exirt about 30m along from this, which you would have though he used, I was doing between 40-50mph as I have done every day since passing my test 6 years ago, the police measured the skid marks at 27m according to the highway code, see below

So i would assume my estimate of the speed to be correct, I know it was wet, but I wouldnt be here to tell the tale if I had been going anything above what I said.

dave im a claims advisor, i take claims and look at the pictures of the incidents to see who is to declare liability, i take claims and discuss with the insured what happened and how they would picture the incident etc... discuss liability and then get there car booked in for repair, also i organise the courtesy cars too :thumb:

 

ive never just done quotes lol what gave you that idea.

So from that information and pictures above who is at fault would you say if it was one you had to assess

Well looking at the description of the accident "half the lorry still in the road" i would assume the lorry pulled out & the escort travelling at accessive speed round a bend to stop in time. Nothing the lorry could do as he was pulling out before the escort came, surely this is the escort drivers fault?

well as i said, insurances dont judge by the speed, but looking at the speed he was travelling, and the fact that he has informed us that the truck was supposebly exiting the wrong junction, the truck driver is more likley to be held at fault for exiting a petrol station on a bad corner (suspecting its a bad corner) when with the length of the lorry he would have been more safer to use the junction further up.

 

if i was to assess that i would say the lorry is at fault.

If you look at the first pic closley, you can see the tyre marks of the lorry, in my oppinion he has almost cut the turning, I hit the first of the two back wheels, while trying to get it into the junction so as to avoid hitting him, so in essence my car was slightly pointing left, I hit the wheel as was re-bounded to where the car ended up, you can clearly see that I have not made past the junction which i have said is about 27 m wide.

Ahh right i thought the truck was turning to drive the same way as you but wasnt he was turning towards you so yeah trucks fault you would have hit the side as he turned

 

Also look where the fire engine is its quite a distance away i dont see this bend

jsut to state before anyone jumps the gun, i state the liability WITH the policy holder, just to confirm that they feel they are right in what they say, i inform the policy holder that our 2 decisions are not final and that the regional claims office (the people who actually deal with the claims) will be making the final decisions with the other insurance.

Why you want to avoid me :O you have basically agreed with me saying its the trucks fault, apmsl :roll:

 

but its Norwich Union Direct, Clubline, RAC, AA, FORD, Post office, and budget apmsl!!! :pancake:

explain how you can pull out of a junction across the path of something that's not there? ?(

 

Hence why i said that it could be classed as a dispute.... :thumb:
